本規約は、枚方市が委託し、事務局が運営する「ひらかたポイント」（以下「本制度」といいます。）をご利用いただくにあたり、遵守いただく事項を定めるものです。

（用語の定義）

第１条　本規約における次の用語の意味は、下記のとおりです。

(1)「ひらかたポイント」：枚方市の事業への参加や協力店での買い物等においてポイントを貯めることができ、協力店でポイントを利用できるサービスをいいます。

(2)「事務局」：株式会社フューチャーリンクネットワーク。枚方市からの委託を受け、同市管理の下、ひらかたポイントを現地事務局を通じ、協力店及び会員に提供する者をいいます。

(3)「現地事務局」：北大阪商工会議所。事務局と共にひらかたポイントを協力店及び会員に提供する者をいいます。

(4)「協力店」：ひらかたポイントを利用できる枚方市内で物販・サービスを提供する事業者、団体等をいいます。

(5)「制度利用者」：本制度利用の意向がある枚方市に在住、在勤又は在学する者をいいます。

(6)「QRカード」：QRコードが印字又はシールが貼付けされている本制度を利用するために必要なカードをいいます。

(7)「ひらかたポイントアプリ」：事務局から協力店及び会員に提供するQRコードが表示されるスマートフォンアプリケーション（以下、「ひらポアプリ」といいます。）をいいます。

(8)「利用者登録」：制度利用者の氏名、フリガナ、性別、生年月日、住所、電話番号及びメールアドレスを登録し、QRカード又はひらポアプリのIDと紐づけることをいいます。

(9)「会員」：利用者登録を行い、QRカード若しくはひらポアプリのいずれか又は両方を持っている者をいいます。

(注)「QRコード」は（株）デンソーウェーブの登録商標です。

（本制度の概要）

第2条　会員は、枚方市の事業への参加や協力店での買物・サービスの利用でポイントを貯めることができます。協力店での会計100円につき1ポイント貯めることができ、貯めたポイントは、協力店で１ポイント１円として利用できます。但し、協力店により、ポイントの付与率及び内容が異なる場合や、一部ポイントを利用できない商品・サービスがあります。

（本規約の適用範囲）

第3条　本規約は、本制度の利用に関する枚方市、事務局と制度利用者の権利義務関係を定めることを目的とし、事務局と制度利用者の本制度の利用に係る一切の関係に適用されます。

2　ひらポアプリについては、制度利用者が、ひらポアプリを携帯電話その他の情報端末（以下、「情報端末」といいます。）にダウンロードし、本規約に同意の上、ひらポアプリの利用を開始した時点で、制度利用者と事務局との間で、本規約の諸規定に従った利用契約が成立するものとします。3　QRカードについては、制度利用者が、QRカードを取得し、本規約に同意の上その利用を開始した時点で、制度利用者と事務局との間で、本規約の諸規定に従った利用契約が成立するものとします。

（本制度利用方法）

第4条　制度利用者はQRカードを入手し、又はひらポアプリを情報端末にダウンロードすることで、本制度の利用を開始します。なお、本制度提供期間中、本制度にかかわる年会費は無料です。

2 本制度の利用及び枚方市が発行するポイントを受け取るためには、原則として、利用者登録が必要です。QRカードの利用者登録は公式ウェブサイト（https://hirakata.mypl.net/article/hirapo_hirakata）の申請フォーム又は枚方市若しくは事務局への申請で登録できます。ひらポアプリは公式フェブサイトからダウンロードすることができ、ひらポアプリから利用者登録ができます。

3 ひらかたポイントの有効期限は、最終利用日から1年後の同日までです。有効期限内に利用（1.ポイントを貯める　2.ポイントを使う）がなかった場合、ポイントは失効します。4  QRカード及びひらポアプリの利用は、原則として会員本人のみとし、他人に譲渡又は貸与することはできません。また、会員が複数枚QRカードを保有し、ポイントがそれぞれのカードに積算されていても、1枚のカードへ合算することはできません。但し、IDの連携によりひらポアプリとQRカードを併用することはできます。5 QRカードのポイント残高照会は、事務局及び協力店のひらポアプリで確認することができます。また、QRカードに記載のID等を公式ウェブサイトに入力することで照会することができます。

（個人情報の取扱について）

第5条 利用者登録された個人情報は枚方市個人情報保護条例に基づき、適切かつ安全に運用するものとします。詳細は別添のひらかたポイント個人情報保護方針をご確認ください。2 本制度の退会に伴う手続きは不要です。ただし、個人情報の消去に関して会員等から申し出があった場合は、ひらかたポイント個人情報保護方針に則り、合理的な期間で消去の対応をします。

（アカウント情報等の管理）

第6条　会員は、QRカードのID等並びにひらポアプリのID、メールアドレス及びパスワード等の情報（以下、「アカウント情報」といいます。）について、自己の責任の下、任意に登録・変更し、管理するものとします。

2 会員は、自身のアカウント情報及びIDに対し付与されたひらかたポイントを第三者に利用させ又は貸与し、譲渡し若しくは売買してはならないものとします。

3 事務局は、IDに対し付与されたひらかたポイントの利用があった場合には、当該IDに紐づく会員が利用したものとし、当該利用によって生じた結果及びそれに伴う一切の責任については、当該会員に帰属するものとします。

4 アカウント情報が盗用され又は第三者に利用されていることが判明した場合、会員は直ちにその旨を事務局に通知するとともに、事務局からの指示に従うものとします。

（QRカードの再発行）

第7条　QRカードは盗難・紛失等による再発行は可能です。ただし、ひらかたポイントの復元はできません。

2 利用者登録されており、本人確認ができた場合においては前項の限りではありません。なお、盗難・紛失等が生じた場合、ポイントの全部又は一部の失効について、事務局は一切の責任を負いません。また、第三者の利用により会員が被害を被った場合においても、事務局は一切の責任を負わないものとします。

3  QRカードの破損の場合、速やかに事務局までお問合せください。当該カードと引き換えに、IDから事務局が電子情報として合理的に確認可能な範囲において当該カードのポイントを引き継ぐことができます。

（禁止事項）

第8条　会員は本制度の利用にあたって、以下の行為をしてはならないものとします。

(1)第三者若しくは事務局の名誉権、財産権、その他の権利を侵害する行為又はそのおそれのある行為。

(2)公序良俗に反する行為、犯罪的行為又はそのおそれのある行為。

(3)虚偽の情報その他、公序良俗に反する又はそのおそれのある情報を事務局に提供する行為。

(4)QRカード若しくはひらポアプリに記録されているすべてのデータを利用しての営利を目的とする行為又はその準備を目的とする行為。

(5)本制度に係るシステム若しくはQRカードについて、これを破壊、分解、解析若しくは複製等を行い、又はそれに関わる行為に協力すること。

(6)QRカードが偽造、変造若しくは不正に作り出された又はその疑いがあるカードを利用すること。

（免責事項）

第9条　事務局は、通常講ずるべきウイルス対策では防止できないウイルス被害、天災地変、通信回線障害等の不可抗力又は事務局が必要と判断した場合、会員に事前通知なく一時的に会員が受けることのできるサービスの提供を停止することについて、会員は予め了承するものとします。また、事務局は、これらの不可抗力によって、事務局におけるデータが消去・変更されないことを保証できません。

2 事務局は、会員が本制度を通じて得る情報などについて、その完全性、確実性若しくは有効性又はこれらを確認する義務を一切負わないものとします。

3 事務局は、ひらポアプリ等の正常な動作を保証するものではなく、会員は、通信環境その他の事情によりひらポアプリ等の全部又は一部を利用できない場合があることを予め承諾の上、ひらポアプリ等を利用するものとします。

4 事務局は、ひらポアプリが全ての情報端末に対応していることを保証するものではありません。情報端末のOSのバージョンアップ等に伴い、ひらポアプリの動作に不具合が生じる可能性があることに、会員は予め了承するものとします。事務局は、かかる不具合が生じた場合に事務局が行うプログラムの修正等により、当該不具合が解消されることを保証するものではありません。また、AppStore、GooglePlay等のサービスストアの利用規約及び運用方針の変更等に伴い、ひらポアプリの一部又は全部の利用が制限される可能性があることを会員は予め了承するものとします。

5 ひらかたポイントの取引は会員と協力店との間で行われるものとし、事務局はひらかたポイントの取引に関連し何らの責任を負わないものとします。ひらかたポイントの取引に関連して協力店との間で生じた取引、連絡又は紛争等については、事務局は一切責任を負いません。

（補則）

第10条 事務局は、天変地異、社会情勢の変化、その他技術上又は営業上の判断など止むを得ない事由により、本制度を終了させることがあります。

2 事務局は、前項の規定により本制度を終了した場合において、ポイントに関して会員等に生じた損害について、責任を負いません。ポイントに関して発生する公租公課その他の費用については、会員が負担するものとします。

3 本規約に関する準拠法は、日本法とします。また、本制度に関連して会員との間で生じた紛争については、千葉地方裁判所又は千葉簡易裁判所を第一審の専属的合意管轄裁判所とします。

4 本制度の利用に関し、会員に損害が発生し、事務局が損害賠償責任を負うとされる場合でも、その賠償責任の範囲は、会員に生じた現実かつ直接の損害に限ります。事務局は予見の有無にかかわらず、特別の事情から生じた損害、逸失利益、間接損害又はその他の損害についての責任は負わないものとします。

5 本制度の運営主体が変更された場合、本規約の記載の事項は新たな運営主体に引き継ぐものとし、登録された個人情報は当該新たな運営主体のもと適切かつ安全に運用、管理するものとします。

6 会員は、事務局が1日以上の予告期間をもって本規約の内容を予告なく変更、改定又は廃止することを予め承諾するものとします。なお、会員は当該改訂があった場合、改定後の規約に従う事を予め了承するものとします。当該予告期間経過後は、改定後の規約の内容が適用されるものとします。また、最新の規約は、公式ウェブサイト又は事務局への問い合わせで確認することができます。

7 ポイントの利用条件及び協力店は、事前の予告なく変更する場合があります。現在の利用条件の詳細は、公式ウェブサイトで確認することができます。変更後の会員の利用をもって利用条件の同意とすることを会員は予め了承するものとします。また、各協力店のサービスの詳細は、各協力店に確認するものとします。

Hirakata Point Terms of Use
This Terms of Use stipulates the items to be observed when using Hirakata Point (hereinafter referred to as "this system"), which is commissioned by Hirakata City and operated by the Hirakata City Office. This agreement defines the items to be observed when using Hirakata Point (hereinafter called "the System"), which is commissioned by Hirakata City and operated by the Hirakata City Office.

(Definition of Terms)

Article 1. The meanings of the following terms in this Agreement are as follows

(1) "Hirakata Point": A service that allows users to accumulate points by participating in Hirakata City projects, shopping at cooperating stores, etc., and to use the points at cooperating stores.

(2) "Secretariat": Future Link Network Co. (2) "Secretariat": Future Link Network, Inc. who is commissioned by Hirakata City and provides Hirakata Point to cooperating stores and members through the local secretariat under the management of Hirakata City.

(3) "Local secretariat": Kita-Osaka Chamber of Commerce and Industry. (3) "Local Office": Kita-Osaka Chamber of Commerce and Industry, which provides Hirakata Points to cooperating stores and members together with the Local Office.

(4) "Cooperating Shops": Businesses, organizations, etc. that provide goods sales and services in Hirakata City where Hirakata Point can be used.

(5) "System user": A person who lives, works or studies in Hirakata City and intends to use this system.

(6) "QR Card": A card with a QR code printed on it or a sticker attached, which is necessary to use the System.

(7) "Hirakata Point App": A smartphone application (hereinafter referred to as "Hirapo App") that displays a QR Code and is provided to cooperating stores and members by the Secretariat. (7) "Hira-Po App": A smartphone application (hereinafter referred to as "Hira-Po App") in which QR codes are displayed that is provided to cooperating stores and members by the Secretariat.

(8) "User registration": Registration of the name, furigana, gender, date of birth, address, telephone number, and e-mail address of the user of the system, and linking them to the QR Card or Hirapo App ID.

(9) "Member": A person who has registered as a user and has either or both a QR Card or Hirapo App.

(Note) "QR Code" is a registered trademark of DENSO WAVE INC.

(Outline of this system)

Article 2. Members can accumulate points by participating in Hirakata City's projects, shopping and using services at cooperating stores. Members can accumulate 1 point for every 100 yen spent at cooperating stores, and the accumulated points can be used as 1 point for 1 yen at cooperating stores. However, the rate and details of point accumulation may differ depending on the Cooperating Shops, and some products and services may not be available for point accumulation.

(Scope of Application of these Terms and Conditions)

The purpose of this agreement is to define the rights and obligations of Hirakata City, the Hirakata City Office, and system users in relation to the use of this system, and applies to all relationships between the Hirakata City Office and system users in relation to the use of this system.

2 The HiraPo Application is used when a System User downloads the HiraPo Application to a cell phone or other information terminal (hereinafter referred to as "Information Terminal"). The HiraPo application is used to provide information on the use of the HiraPo system, and the HiraPo application is used to provide information on the use of the HiraPo system. The QR Card is used only when the QR Card user acquires the QR Card and starts using it after agreeing to these Terms and Conditions.

（Article 4.)

System users shall start using the System by obtaining a QR Card or downloading the Hirapo application to their information terminal. There is no annual fee for this system during the period when this system is offered.

2 In order to use this system and receive points issued by Hirakata City, you need to register as a user in principle. Hirakata City or the Hirakata City Office. Hirapo application can be downloaded from the official website, and user registration is available through Hirapo application.

3 Hirakata points are valid until the same day one year after the last day of use. Points will expire if they are not used (1. to accumulate points, 2. to use points) within the expiration date. 4 In principle, QR Cards and Hirapo Apps may only be used by the member him/herself, and may not be transferred or loaned to others. Even if a member has multiple QR Cards and points are accumulated on each card, they cannot be combined into a single card. However, the Hirapo application and the QR Card can be used together by linking IDs.5 The point balance of the QR Card can be checked at the Hirapo application at the Secretariat and at the Cooperating Shops. In addition, the QR Card can be inquired by entering the ID and other information on the QR Card on the official website.

(Handling of Personal Information)

Article 5 Personal information registered by users shall be handled appropriately and safely in accordance with Hirakata City Personal Information Protection Ordinance. For details, please refer to the attached Hirakata Point Personal Information Protection Policy.2 No procedure is required for withdrawal from this system. However, if there is a request from a member, etc. regarding the deletion of personal information, the deletion will be handled within a reasonable period of time in accordance with the Hirakata Point Personal Information Protection Policy.

(Management of account information, etc.)

Members are responsible for managing their QR Card IDs, Hirapo App IDs, email addresses, passwords, and other information (hereinafter referred to as "account information"). Members shall register, change, and manage their QR Card IDs, Hirapo App IDs, email addresses, passwords, and other information ("Account Information") at their own risk.

2 Members shall not allow a third party to use, lend, transfer, or sell their account information or Hirakata Points granted to their ID.

3 The secretariat assumes that any use of Hirakata points granted to an ID is made by the member associated with that ID, and that the member is responsible for any and all consequences and liabilities arising from such use.

4 If it is discovered that account information has been stolen or used by a third party, the member shall immediately notify the Secretariat to that effect and follow the instructions of the Secretariat.

(Re-issuance of QR Cards)

QR Cards can be reissued due to theft or loss. However, Hirakata points cannot be restored.

2. The preceding paragraph does not apply to cases where the user has been registered and the identity of the user has been verified. The Secretariat will not be held responsible for any loss of all or part of the points in the event of theft or loss. The Secretariat shall also assume no responsibility for any damage incurred by a member due to use by a third party.

3 In case of damage to the QR Card, please contact the Secretariat as soon as possible. In exchange for such card, the points on the card may be transferred from the ID to the extent reasonably ascertainable by the Secretariat in the form of electronic information.

(Prohibited Matters)

Article 8. Members shall not engage in any of the following acts when using the System

(1) Infringing or threatening to infringe on the honor rights, property rights, or other rights of a third party or the Secretariat

(2) Actions that are or may be offensive to public order and morals, or that are or may be criminal

(3)Any act of providing false information or any other information that is or may be offensive to public order and morals to the Secretariat.

(4)Actions for the purpose of profit-making using all data recorded on the QR Card or Hirapo application, or actions in preparation for such actions.

(5)Destroying, disassembling, analyzing, or duplicating the system or QR Cards related to the System, or cooperating in any related activities.

(6) Use a QR Card that is counterfeit, altered, or fraudulently created, or is suspected of being so.

(Disclaimer)

Article 9. Members agree in advance that the Secretariat may temporarily suspend provision of services to which they are entitled without prior notice to them in the event of force majeure such as virus damage that cannot be prevented by ordinary virus countermeasures, natural disasters, communication line failures, or when the Secretariat deems it necessary. The Secretariat cannot guarantee that data in the Secretariat will not be erased or altered due to such force majeure.

2 The Secretariat shall have no obligation to check the completeness, certainty, or validity of any information obtained by members through this system.

3 The Secretariat does not guarantee the proper operation of the Hirapo application, etc., and members shall use the Hirapo application, etc., with the prior consent that they may not be able to use all or part of the Hirapo application, etc., due to the communication environment or other circumstances.

4. The Hirapo application is not guaranteed to be compatible with all information terminals. Members agree in advance that the Hirapo application may malfunction due to upgrades to the OS of the information terminal. The Hirapo Secretariat does not guarantee that any program modifications, etc. made by the Secretariat will resolve any such problems that may arise. In addition, members shall acknowledge in advance that the use of some or all Hirapo applications may be restricted due to changes in the terms of service and operating policies of service stores such as AppStore and Google Play.

5 Transactions of Hirakata Point shall be conducted between members and cooperating stores, and the secretariat shall not bear any responsibility in relation to transactions of Hirakata Point. The Secretariat shall not be liable for any transaction, communication, dispute, etc. with a Cooperating Shop in connection with transactions of Hirakata Point.

(Supplementary Provisions)

1 The Secretariat may terminate this scheme for unavoidable reasons, such as natural disasters, changes in social conditions, or other technical or business decisions.

2. The Secretariat shall not be liable for any damage incurred by members in relation to points in the event that the program is terminated in accordance with the preceding paragraph. Members shall be responsible for any taxes, public dues, and other expenses incurred in connection with points.

3. The Terms and Conditions shall be governed by the laws of Japan. Any disputes arising between members in relation to this program shall be subject to the exclusive jurisdiction of the Chiba District Court or Chiba Summary Court as the court of first instance.

4 Even in the event that a member incurs damages in connection with the use of the System and the Secretariat is held liable for compensation, the scope of its liability shall be limited to actual and direct damages incurred by the member. The Secretariat shall not be liable for damages arising from special circumstances, lost profits, indirect damages, or other damages, regardless of whether they were foreseen or not.

5 In the event of a change in the operating entity of the System, the matters described in the Terms and Conditions shall be transferred to the new operating entity, and the personal information registered shall be operated and managed appropriately and securely by the new operating entity.

6. Members agree in advance that the Secretariat may change, revise, or abolish the Terms of Use without prior notice with a notice period of at least one day. In the event of any such revision, the member agrees in advance to abide by the revised terms. After such notice period, the revised terms shall apply. The latest version of the Terms and Conditions can be found on the official website or by contacting the Secretariat.

7 Terms and conditions for the use of points and cooperating stores are subject to change without prior notice. Details of the current terms of use can be found on the official website. Members shall agree in advance that their use of the service after the change constitutes their agreement to the terms and conditions of use. Members shall also check with each cooperating store for details of its services.
